Bed Bugs treatment warranty:
Subject to the limitations contained in this agreement, Bed Bug Authority Canada warrants it will eradicate 100% of bed bug infestations including their eggs in the treated areas. BBAC will not be responsible for any cross contamination or any new infestations that may be introduced by bringing infested items, persons or pets into areas previously treated or migration from untreated areas or units in multi-unit dwellings.
Proof of existence of a bed bug presence, post treatment, will be in the form of live bugs established in the treated area and the existence of said bed bug presence to be confirmed by a BBAC representative. Bed bug fecal stains or skin irritation will not be regarded as evidence of bed bug presence, post treatment.
Extraordinary expenses associated with proving the existence of an infestation, post treatment, is the responsibility of the client.
BBAC reserve the right to select method and strategy and schedule any necessary work related to re-treatment. This warranty is valid for a predetermined number of days from the completion of the work.
Limitation of warranty and liability:
Predetermined warranty term.
Length of warranty will be predetermined and expressed in a number of days, prior to commencement of work. The maximum warranty period is 90 days and applies to a single family detached home.
The term will be based on affecting factors, such as, number of families or persons residing in the home, type of structure, whether home is detached, semi detached, a townhouse, multi unit dwelling (condo or apartment) or with high traffic or densely populated conditions. Hotels, motels, rooming houses, shared accommodations, multi-unit dwellings, condo and apartment buildings, and rental properties may not qualify for a warranty or have a limited warranty. Properties where the infestation is structural. ie;(the bug harborage is established in the walls and floors) may require continued treatment. Structural infestations are caused by persons sleeping on the floor, mattresses / box springs sitting directly on the floor without bed frames, also in situations where people sit on the floors without couches or chairs.
The client is required to follow all preparation instructions set forth in the Instruction Sheet and any additional instructions verbally provided by a representative of BBAC. Failure to comply may compromise the treatment and void any warranty, whether expressed or implied. In providing the services under this contract, BBAC makes no additional warranties whatsoever, either expressed or implied, oral or written, in fact or by operation of law or otherwise, except as expressly stated in this contract.
BBAC it’s officers, directors, agents and servants and its affiliates and their respective officers, directors, agents and servants shall not be liable to the client nor any other party for losses or damages including without limitation, economic and consequential losses, or direct or indirect, incidental, exemplary and punitive damages whether in contract, tort or otherwise or any other claims or expenses in any manner resulting, including without limitation liability, losses or damages directly or indirectly from or connected with, the work, or by reason of any action, omission, active negligence, passive negligence or any error or omission in the work, or by reason of misstatement, imprudence, lack of skill or error of judgement of or by BBAC or its officers, directors, agents and servants or its affiliates and their respective officers, directors, agents and servants.
Warranty is non transferable.
